Department of Justice Enters Legal Challenge to Block the State of California's Redistricting Plan
The US Justice Department has officially joined a legal challenge initiated by California Republicans, aiming to prevent the California's newly approved electoral boundaries.
This court case, submitted to a US district court, challenges the redistricting plan championed by the state's Democratic governor, which was created in response to a GOP redistricting effort in Texas.
"California's electoral map constitutes a brazen power grab that violates civil rights and mocks the democratic process," stated the US attorney general.
The Democratic party have voiced assurance that the new maps will survive legal scrutiny.
"These opponents lost at the ballot box and soon they will also lose in court," stated a representative for the governor.
Constitutional Challenge
The lawsuit asserts that California's map improperly used racial considerations to heavily favor Latino communities in violation of the US Constitution.
"It is unconstitutional to use race as a substitute to further partisan goals, but that is precisely what the California General Assembly did with Proposition 50," argued a senior official from the DOJ's civil rights unit.
Broader Implications
The legal battle represents the most significant counterpunch by the Democratic party in the continuing redistricting war that started with Texas and has extended to various parts of the country.
Unlike other states, where Republican state legislatures have enacted gerrymanders, California's plan needed voter approval, which it received with approximately two-thirds of the vote.
National Implications
The Democratic party need to flip just a handful of GOP-controlled House seats to take control of the House of Representatives in next year's midterm election.
The party that holds the controlling share will influence the final years of the sitting president's term, deciding if a GOP-controlled legislature will continue to deliver its political program or face resistance, investigations and possible additional obstacles.
